By accessing, downloading, or using the AchiPay platform, website, or WhatsApp-based services ("the Service"), you agree to be bound by these Terms of Service, a legally binding agreement between you and JAFA Tech Limited ("AchiPay", "we", "us", "our"). If you do not agree to these Terms, you must not use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these Terms.
You must be at least 18 years old to use the Service, and by registering you confirm you are legally capable of entering a binding agreement in your country of residence. You confirm you are not prohibited from using financial services under any applicable law, and you are solely responsible for compliance with laws applicable to your use of the Service. AchiPay operates only in select countries, and we reserve the right to restrict access in any country at any time.
To access the Service you must register an account with accurate, complete, and up-to-date information, and update it promptly if it changes. You are solely responsible for the confidentiality and security of your account credentials, including your 6-digit transaction PIN and password. You must never share your PIN or credentials with anyone — including AchiPay staff, as AchiPay will never ask for your PIN. You agree to notify us immediately at info@achipay.com of any suspected unauthorised access, and we are not liable for losses resulting from unauthorised access if you fail to keep your credentials secure. Your account is personal and non-transferable — you may not sell, rent, lease, or transfer it to any third party.
All users must complete identity verification ("Know Your Customer" or KYC) before sending money or accessing certain features, as a legal requirement to prevent fraud, money laundering, and other financial crimes. You agree to provide your full legal name, date of birth, residential address, government-issued identification, proof of address, a selfie photograph, and any additional information we require. We use regulated third-party verification services, and by accepting these Terms you consent to the collection, processing, and sharing of your data for verification purposes, and its retention as required by law. We reserve the right to suspend or terminate your account if you fail to complete verification or if we cannot verify your identity.
AchiPay is designed for legitimate personal and business money transfers, and you agree to use the Service only for lawful purposes. You must not use the Service for money laundering or proceeds of crime, fraud or deceptive activity, terrorist financing, illegal gambling, drug trafficking, human trafficking, sanctions violations (transacting with anyone subject to UN, UK, US, EU, or other recognised sanctions), or any other illegal activity under UK, Nigerian, or your country's laws. Unless expressly authorised in writing, you may not use the Service as a payment processor for other businesses, to facilitate transfers for unapproved third parties, or to resell the Service. You also agree not to interfere with or disrupt the Service, attempt unauthorised access, use bots or scrapers, reverse engineer any part of the Service, or act in a way that harms AchiPay's brand reputation.
All fees are displayed clearly before you confirm a transaction, including the service charge, any currency conversion fees, and applicable tax on the service charge. We are committed to transparency and do not charge hidden fees. We may adjust fees from time to time, with advance notice via the Service or email, and continued use after a fee change constitutes acceptance of it. You are responsible for any fees charged by third parties, including your bank, payment provider, mobile network operator, or intermediary banks handling currency conversion.
Transfer limits depend on your identity-verification tier: unverified accounts cannot send money, Tier 1 verified accounts have daily and monthly limits shown in the app, and Tier 2 verified accounts have higher limits subject to enhanced verification. Limits may also vary by country due to local regulatory requirements and will be displayed before you initiate a transaction. You may request a limit increase by providing additional information to our compliance team, and we reserve the right to approve or deny such requests.
If a transfer fails due to technical issues, incorrect recipient details, or rejection by the recipient's bank, funds are automatically reversed to your AchiPay wallet. For any transaction dispute, you must contact info@achipay.com within 7 days of the transaction date, and we will investigate and respond within a reasonable timeframe. If you believe a transaction was unauthorised or fraudulent, contact us immediately so we can work with our payment partners to resolve it. We are not liable for losses resulting from incorrect recipient details you provided, your failure to verify recipient details, or transactions sent to the wrong recipient due to your error. Full details are in our Refund Policy, which is incorporated into these Terms by reference.
We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent or illegal activity, fail identity verification, if we suspect unauthorised access, if you provide false or misleading information, or if required by law or a regulatory authority. During suspension we may investigate your account activity and will cooperate with law enforcement and regulators as required. You may close your account at any time by contacting info@achipay.com; upon closure any remaining wallet balance will be transferred to your verified bank account, subject to applicable fees. On termination you lose access to the Service, your wallet is frozen pending final settlement, and we may retain your data as required by law.
The Service is provided "as is" and "as available", with no warranties regarding its reliability, availability, security, transaction accuracy, or fitness for your particular purpose. To the maximum extent permitted by law, AchiPay and its affiliates, directors, employees, and agents are not liable for direct, indirect, incidental, special, or consequential damages, or loss of profits, revenue, or data. Our total liability for any claim is capped at the fees you paid to AchiPay in the preceding 12 months, or £500, whichever is lower. We are not responsible for delays or failures caused by banks, payment providers, mobile network operators, third-party systems beyond our control, or force majeure events, nor for losses arising from your own errors, such as inaccurate recipient details or failing to secure your PIN.
All intellectual property in the Service — including the AchiPay trademarks and logo, source code and software, design and user interface, and website content — is the exclusive property of JAFA Tech Limited or our licensors. You may not copy, modify, or distribute any part of the Service, use our trademarks, or reverse engineer or decompile our software without written consent. If you provide feedback or suggestions, you grant us an unrestricted, perpetual, royalty-free licence to use it without compensation.
Our Privacy Policy governs the collection, use, and storage of your personal data, and by using the Service you consent to that processing. We implement industry-standard security measures, including end-to-end encryption for WhatsApp messages, secure authentication, and regular security audits, and retain your data only as long as necessary to provide the Service and meet legal obligations.
We may use third-party payment processors, and your use of their services is subject to their own terms. AchiPay uses the WhatsApp Business API to deliver payment services, so your use of WhatsApp is also subject to WhatsApp's Terms of Service and Privacy Policy. Our website may link to third-party sites for which we are not responsible.
We may update these Terms to reflect changes to the Service, legal or regulatory requirements, or operational reasons. We will notify you of significant changes via WhatsApp message, email, or a prominent notice on our website. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms; if you disagree, you must stop using the Service.
These Terms are governed by the laws of England and Wales. Disputes are referred to and finally resolved by arbitration in London under the rules of the London Court of International Arbitration (LCIA). The courts of England and Wales have exclusive jurisdiction where arbitration does not apply or as required for enforcement. To the fullest extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in a class action or class arbitration.
You agree to indemnify, defend, and hold harmless JAFA Tech Limited, its directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms or any law or third-party rights, or your fraudulent or unlawful activity.
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions continue in full force, with the invalid provision interpreted to reflect the parties' original intent. Our failure to enforce any right or provision is not a waiver of it, and any waiver must be in writing and signed by an authorised AchiPay representative. We are not liable for failure to perform our obligations due to events beyond our reasonable control, including acts of God, war, pandemics, government action, power or network outages, cyberattacks, or labour disputes.
